Welcome to Pith. These Terms of Service ("Terms") govern your access to and use of the Pith platform, including our website, applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using Pith, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the Service, including visitors, registered users, and contributors.
Important: If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Eligibility
To use Pith, you must:
- Be at least 13 years of age (or the age of majority in your jurisdiction)
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
- Maintain the security and confidentiality of your account credentials
If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service.
3. Account Registration and Security
3.1 Account Creation
To access certain features of the Service, you must register for an account through our authentication provider, Clerk. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your login credentials confidential
- Notify us immediately of any unauthorized access to your account
3.2 Account Responsibility
You are responsible for all activities that occur under your account. You agree not to:
- Share your account credentials with others
- Create multiple accounts for fraudulent purposes
- Impersonate another person or entity
- Use another user's account without permission
3.3 Account Termination
You may delete your account at any time through the Settings page. We may suspend or terminate your account if you violate these Terms or engage in prohibited conduct.
4. License to Use the Service
Subject to your compliance with these Terms, Pith grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
This license does not include any rights to: (a) resell or make commercial use of the Service; (b) collect or use product listings, descriptions, or prices; (c) make derivative uses of the Service; (d) download or copy account information; or (e) use data mining, robots, or similar data gathering tools.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

6.1 Our Content
All content on the Service, including text, graphics, logos, icons, images, audio clips, software, and AI-generated summaries, is the property of Pith or its content suppliers and is protected by intellectual property laws. The Service as a whole is protected by copyright and other laws.
6.2 Third-Party Content
Pith aggregates content from Hacker News and various AI blogs. We respect the intellectual property rights of content creators and provide:
- Proper attribution to original sources
- Links to original articles
- AI-generated summaries for informational purposes (fair use)
- Compliance with robots.txt and content usage policies
6.3 User Preferences and Data
You retain ownership of your personal preferences, reading history, and account data. By using the Service, you grant us a limited license to use this data to:
- Personalize your content feed
- Improve our recommendation algorithms
- Analyze usage patterns (in aggregate, anonymized form)
- Provide and enhance the Service
6.4 AI-Generated Summaries
Summaries generated by Claude AI are created for informational purposes. While we strive for accuracy, AI-generated content may contain errors or omissions. You should refer to original sources for complete and authoritative information.
7. AI Services and Third-Party Integrations
Pith uses Anthropic's Claude AI to generate article summaries and provide intelligent content curation. By using our Service, you acknowledge and agree that:
- AI-generated summaries are provided "as-is" for informational purposes
- AI outputs may occasionally contain inaccuracies or biases
- We process article content through Anthropic's API (subject to their terms and privacy policy)
- You should verify important information with original sources
- We are not responsible for decisions made based solely on AI-generated content
We also integrate with:
- Clerk: Authentication and user management
- Vercel: Hosting and analytics
- Hacker News API: News content aggregation
Your use of these third-party services through Pith is subject to their respective terms and policies.
8. Disclaimers and Warranties
Important Legal Notice
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Pith does not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- AI-generated summaries will be complete, accurate, or free from errors
- Any defects in the Service will be corrected
- The Service will meet your specific requirements
- Content from third-party sources will always be available
You use the Service at your own risk. Any material downloaded or obtained through the Service is accessed at your own discretion and risk.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
This limitation applies to damages arising from:
- Use or inability to use the Service
- Unauthorized access to your account or data
- Errors, mistakes, or inaccuracies in content
- AI-generated content or recommendations
- Third-party conduct or content on the Service
- Service interruptions or security breaches
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Pith and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
- Any content you submit or transmit through the Service
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you will cooperate with our defense of such claims.
11. Dispute Resolution and Arbitration
11.1 Informal Resolution
Before filing a formal dispute, you agree to contact us at legal@getpith.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute through good-faith negotiation within 60 days.
11.2 Binding Arbitration
If we cannot resolve the dispute informally, any dispute arising from these Terms or the Service will be resolved through binding arbitration, except that:
- You may assert claims in small claims court if they qualify
- Either party may seek injunctive relief in court for intellectual property infringement
Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association's rules. The arbitration will take place in [Jurisdiction], and judgment on the award may be entered in any court having jurisdiction.
11.3 Class Action Waiver
You agree that disputes will be resolved on an individual basis. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
12. Termination
12.1 Termination by You
You may terminate your account at any time by deleting it through the Settings page or contacting us at support@getpith.com.
12.2 Termination by Us
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you:
- Breach these Terms
- Engage in fraudulent or illegal activities
- Violate the rights of others
- Pose a security risk to the Service or other users
12.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the Service shall be instituted in a court in [Jurisdiction], and you consent to the personal jurisdiction of such courts.

15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pith regarding the Service.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15.3 Waiver
No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
15.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
15.5 Force Majeure
We shall not be liable for any failure to perform due to causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

You agree to comply with all applicable export and import laws and regulations in your use of the Service.
